7. Equine and Horse-Related Disclaimer
STABLE Pro is a technology platform and does not provide veterinary, medical, training, boarding, farrier, transportation, riding, or other professional care for horses.
You are solely responsible for the care, supervision, treatment, transportation, training, boarding, and management of any horse associated with your use of the Services.
Horses are animals and may become ill, injured, escape, behave unpredictably, or die despite appropriate care. STABLE Pro does not guarantee the health, safety, condition, performance, or survival of any horse.
To the fullest extent permitted by applicable law, STABLE Pro is not responsible for any illness, injury, death, loss, deterioration, escape, accident, or other harm involving a horse, or for any resulting costs, damages, claims, or expenses.
Any horse-related information, records, schedules, reminders, communications, or other information entered into or generated through the Services is provided for administrative and informational purposes only. The Services are not a substitute for veterinary care or other qualified professional advice. You are responsible for independently verifying information and obtaining appropriate professional care or advice when necessary.
8. Third-Party Services
The Services may integrate with or provide links to third-party websites, applications, payment processors, financial institutions, communication services, or other third-party products and services.
Third-party services are provided by their respective providers and may be subject to separate terms and privacy policies. STABLE Pro does not control and is not responsible for the availability, accuracy, security, or performance of third-party services. Your use of third-party services is at your own risk.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW.
STABLE PRO DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPLETELY ACCURATE, OR THAT ANY INFORMATION OR DATA PROVIDED THROUGH THE SERVICES WILL ALWAYS BE AVAILABLE OR PRESERVED. YOU USE THE SERVICES AT YOUR OWN RISK.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STABLE PRO TECHNOLOGIES, INC. AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF DATA, BUSINESS INTERRUPTION, OR OTHER SIMILAR LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, STABLE PRO'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO STABLE PRO FOR THE SERVICES DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $1,000.
Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, applicable limitations will apply only to the extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless STABLE Pro Technologies, Inc. and its owners, officers, employees, contractors, affiliates, and agents from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:
- Your use of the Services;
- Your User Content;
- Your violation of these Terms;
- Your violation of applicable law or the rights of another person or entity; or
- Your actions or omissions in connection with a horse, client, customer, transaction, or other person or property associated with your use of the Services.
12. Data and Information
We may collect, store, and process information in connection with your use of the Services as described in our Privacy Policy.
You are responsible for maintaining appropriate backups of information you enter into the Services. Although we may maintain routine backups and security measures, we do not guarantee that your information will never be lost, corrupted, deleted, or inaccessible.
You acknowledge that no electronic storage or transmission system can be guaranteed to be completely secure.
13. Suspension and Termination
We may suspend or terminate your access to the Services if you violate these Terms or applicable law, or if we reasonably believe your use of the Services creates a security, legal, or operational risk.
You may stop using the Services at any time and may cancel your subscription according to the applicable cancellation terms.
Upon termination, your right to access the Services may immediately end. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute-resolution provisions, will survive.
14. Modifications and Interruptions
We may modify, update, suspend, or discontinue the Services or any feature at any time.
We are not responsible for delays, interruptions, outages, maintenance, technical failures, or other circumstances that prevent or limit access to the Services. We will use reasonable efforts to maintain the Services but do not guarantee uninterrupted availability.
15. Dispute Resolution
These Terms and your use of the Services are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
Before initiating formal proceedings, the parties agree to first attempt in good faith to resolve any dispute through informal written negotiations for at least thirty (30) days.
Except for disputes that are legally excluded from arbitration, unresolved disputes will be resolved through binding arbitration in accordance with the applicable rules of the American Arbitration Association.
Nothing in this section prevents either party from seeking temporary or permanent injunctive relief where permitted by law, or from pursuing claims that cannot legally be subject to arbitration. To the extent a dispute may properly proceed in court, the parties consent to the applicable state or federal courts located in Nevada.
16. Electronic Communications and Signatures
By using the Services, you consent to receive communications, notices, agreements, disclosures, and other information electronically.
You agree that electronic signatures, electronic records, electronic notices, and electronic transactions satisfy any legal requirement that such communications or agreements be in writing, to the extent permitted by applicable law.
17. General Terms
These Terms, together with our Privacy Policy and any additional terms expressly incorporated into the Services, constitute the entire agreement between you and STABLE Pro regarding your use of the Services.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
You may not assign your rights or obligations under these Terms without our prior written consent. STABLE Pro may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or other business transaction.
Nothing in these Terms creates a partnership, joint venture, employment, fiduciary, or agency relationship between you and STABLE Pro. We are not responsible for delays or failures caused by circumstances beyond our reasonable control.
